Legal Help

  • Every year, hundreds of thousands of children enter the foster care system, and far too often, their voices are ignored as life-changing decisions are made about their safety, stability, and future. At The Center for the Rights of Abused Children, we believe no child should ever have to walk the path to a loving home alone. We offer free legal support and effectuate legislative change because every child deserves someone in their corner, standing up for their rights. But our work is just one part of a greater effort. By understanding what abused children face—and how the right legal support can change their stories—you can help ensure that no child is left to live in fear and uncertainty. What Rights Do Children in Foster Care Have? Every child deserves to feel safe, valued, and supported, and specific rights exist to ensure just that for those in the foster system. The right to be safe in state custody The right to family integrity The right to emotional security The right to permanency in a timely manner The right to an adequate education Unfortunately, most children do not know these rights. And even among those who do, only half know where to turn if those rights are violated. What Can Go Wrong When Rights Are Violated? The Realities for Children Legal proceedings are daunting for any child, even more so for children whose lives have already been upended by trauma. Despite this, many in abuse or neglect cases have an overburdened or disengaged attorney—or no attorney at all. Without a strong, compassionate legal advocate, their voices go missing from critical decisions, and urgent needs can, and do, go overlooked. This lack of advocacy has real, devastating consequences. Did you know? 1 in 3 children reunited with their families will be abused again and re-enter care. And safety isn’t only a risk after reunification. Many children in the foster care system undergo mistreatment, neglect, or further abuse. Some are separated from their siblings or left in the dark about why they were moved and what happens next. Even with landmark protections like the Foster Care Bill of Rights, children’s voices may still be dismissed and their needs left unmet. Sadly, these stories are all too common, but meaningful change is possible. By seeking out effective, child-centered legal help, individuals can help rewrite the future for children who have endured so much pain and instability. Why Does Legal Advocacy Matter? The Center’s Impact Free legal support can mean the difference between a child languishing in the system and finally finding a safe, permanent home. National Legal Network: We connect families and caregivers with experienced attorneys and advocates ready to take the immediate action vulnerable children need. High-Level Solutions: We drive policy reform to address key issues, such as disrupted education and broken family connections, and to ensure the welfare system’s power never goes unchecked. Whether in courtrooms or state capitols, The Center for the Rights of Abused Children has changed the lives of more than one million children nationwide. With legal representation, children exit foster care for families up to 3.5 times faster. How Do You Know When to Seek Legal Help? Identifying when legal help is required can be the first, and most vital, step in protecting a child’s rights and future. While every child and every story is unique, there are common signs that may signal the need for urgent action. You should seek assistance if: A child’s safety concerns are ignored or minimized. They remain in or are returned to a harmful situation. A child is stuck in legal limbo, waiting for resolution or permanency due to court delays and inaction. Family connections are unjustly blocked. A child is separated from siblings or other loved ones without clear and just cause. A child’s education is disrupted, which may include frequent school changes, lack of necessary services, or neglect of special education needs. A child’s property or benefits are misused. Funds intended for their future are diverted for other purposes. If you see any of these warning signs: Speak up: If you believe a child is in imminent danger, contact local authorities or child protective services immediately. Document concerns: Keep a record of what you observe and what the child shares with you, including dates and details. Seek legal help: Reach out to The Center. We will connect you with free legal aid tailored to the child’s needs. An estimated 20 percent of children in the U.S. foster care system have been trapped in the system for more than three years. But with the right support, every child can find a permanent, loving home. Remember: Hope and Healing Are Possible Free legal support can change the course of a life. It ensures children’s voices are heard, their rights are respected, and their future is protected.
